● Legal guarantee of compliance

○ Definition

In order to comply with these Terms and Conditions, the product must be suitable for the use usually expected of a similar product and, if applicable, for the use made of it:

- correspond to the description given by ELWING and possess the qualities that the latter has presented to the Client;

- present the qualities that a Client can legitimately expect given the public declarations made by ELWING, notably in advertising or labelling;

Non-conformities which appear within twenty-four (24) months following the delivery of the goods are presumed to exist at the time of delivery, unless there is proof to the contrary.

○ Implementation

The customer is entitled to demand that the product conforms to the contract. However, he may not contest the conformity by invoking a defect which he knew or could not have been unaware of at the time of the conclusion of the contract. The same applies if the defect has its origin in the materials supplied by him.

In the event of a lack of conformity, the customer shall choose between repair or replacement of the product.

When replacement of the product is impossible, the customer may return the product and be refunded the price or keep the product and be refunded part of the price.

The application of the provisions of articles L217-4 to L217-14 of the Consumer Code is free of charge for the customer.

○ Legal provisions - Consumer Code

■ Article L217-4

The seller delivers goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery.

He is also liable for any lack of conformity resulting from packaging, assembly instructions or installation when this was imputed to him by the contract or was carried out under his responsibility.

○ Article L217-5

The goods are in conformity with the contract:

1 ° If it is suitable for the normally expected use of similar goods and, where appropriate :

- if it corresponds to the description given by the seller and has the qualities which the latter has presented to the buyer in the form of a sample or model ;

- if it has the qualities that a buyer can legitimately expect in the light of public statements made by the seller, the producer or his representative, particularly in advertising or labelling;

2° Or if it has the characteristics defined by mutual agreement between the parties or if it is suitable for any special use sought by the buyer, brought to the knowledge of the seller and accepted by the latter.

○ Article L217-10

1° If the solution requested, proposed or agreed in application of Article L. 217-9 cannot be implemented within one month of the buyer's complaint;

2° Or if this solution cannot be without major inconvenience for him, given the nature of the goods and the use he is seeking.

However, the sale may not be cancelled if the lack of conformity is minor.

○ Article L217-12

The action resulting from the lack of conformity shall become time-barred two years after delivery of the goods.

● Warranty against hidden defects

○ Implementation

The Client may, after prior formal notice from the site manager and an attempt at amicable resolution, implement the guarantee for hidden defects.

○ Legal provisions - Civil Code

■ Article 1641

The seller is bound by the guarantee on account of hidden defects in the item sold which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would have paid a lower price for it, if he had known about them.

○ Article 1648

The action resulting from hidden defects must be brought by the buyer within two years of the discovery of the defect.

● Manufacturer's warranty

○ What does the manufacturer's warranty cover?

The manufacturer's warranty covers all costs of returning cards purchased from one of our authorised resellers or from our website.

IMPORTANT: Our guarantee is not valid outside the European Union.

○ Condition for taking over the manufacturer's warranty :

As this guarantee is exceptional, it applies in the event of normal use of the commission. We therefore rely on the honesty of our customers.

○ Procedure for warranty coverage :

Please contact our customer service department at the following address: support@elwingboards.com.

Our customer service will contact you as soon as possible to establish a remote diagnosis.

In most cases, the problem can be diagnosed remotely and therefore be repaired quickly. We therefore rely on our customers' frankness as to the reason for the failure.

○ In which cases can the manufacturer's warranty be refused?

Reminder of the law on commercial guarantees: "As this guarantee is a complement to the legal guarantees, the manufacturer sets its own conditions".

However, we remind you that our objective is to do our best to satisfy our customers. However, in the following cases, we will refuse to accept your product under the manufacturer's guarantee :

○ Lack of civility towards our team: Anyone showing a lack of respect towards our team will lose the manufacturer's warranty.

○ Honesty: Anyone who has not told the truth about the origin of the defect and has wasted our team's time will lose the manufacturer's warranty.

○ Anyone who has deliberately degraded the brand, issued a negative opinion or revealed its failure on social networks without first contacting our customer service department.

○ Presence of traces of water inside our components.

○ Defect caused by a fall or any other event that is not related to a defect in the board.

○ Damage during transport.


○ Parts covered by the manufacturer's warranty :

The warranty ends when one of the two terms is reached.

For the Yuvy :

This guarantee takes effect from the date of purchase. It is only granted for normal use of the bicycle.

The frames and all components mounted on our bikes are guaranteed against manufacturing defects for a period of 2 years.

The Samsung battery is guaranteed to have a minimum residual capacity of 70% after 2 years or 500 full charge cycles.

The finishes are guaranteed against manufacturing defects for a period of 1 year from the date of purchase.

For all POWERKIT :

The battery: 12 months warranty or 500 cycles

Motherboard: 24 month warranty

The engine: 6 months warranty

Remote control: 6 months warranty

Lights: 6 month warranty

Battery charger: 24 month warranty


For electric skateboards before the POWERKIT :

The battery: 12 months warranty or 500 cycles

Motherboard: 12 month warranty

The engine: 6 months warranty

Remote control: 6 months warranty

Battery charger: 24 month warranty


For the refurbished POWERKIT :

The battery: 12 months warranty or 500 cycles
